I was recently called to attend a meeting in my principal's office.  After a few comments by my administrator I realized I was in trouble. What should I have done? What are my rights?

 


If I become sick during my work day and need to go home who is responsible to get coverage for my class?
Article 18.9 states that "in the event a substitute is not available, a regular teacher who upon the request of an admistrator volunteers to serve may be used as a substitute during his/her conference period."  By contract teachers are entitled to sick leave. Follow your site protocol. Let your administrator know and go home!  If a teacher declines to substitute, the administrator will respect that decision. Elementary teachers who take extra students when a substitute is not available will equally divide the one-day compensation for a long-term substitute. Teachers must submit an hourly time sheet to receive pay.

If I relocate to another school district in California what happens to my sick leave?
Your sick leave transfers to your new school district in California. It is your responsibility to notify your current district of your impending move. Your current district will transfer your sick leave to your new district. Be sure to get written confirmation that the transfer has occurred.

What happens to my sick leave if I resign from my school district and do not plan on teaching for several years?
In the event that a teacher resigns from a school district and takes a leave from teaching the accrued sick leave can be held for up to two (2) years. At the end of the two years the sick is no longer transferable thus not available to the teacher. There is no cash-out option. This is per Ed. Code and STRS.

What happens to my sick leave if I retire?
If you are 55 years of age or older a portion of your sick leave can be used toward your STRS. A STRS counselor will explain this process when you meet with them.

STOP THE MEETING IMMEDIATELY! Under the Weingarten Ruling you are entitled to union representation but it is your responsibility to ask for this representation--the administrators do not have to offer it to you. You may ask your Site Rep or VTA leadership to attend the meeting with you. It is always helpful to have someone there to take notes and be an advocate.
